Pesticides: Regulatory setback distances to observe

In France, spraying pesticides near inhabited zones is tightly controlled by law. Facing health risks, mandatory safety distances have been established to shield nearby residents and vulnerable individuals from phytopharmaceutical products. While this practice is strictly prohibited for individuals, punishable by fines up to €150,000 and six months in jail, farmers must adhere to highly precise rules. Failing to comply with these setback distances can lead to legal action for an abnormal neighbor disturbance.

The safe distance mainly depends on the nature of the phytopharmaceutical product used. Some products are entirely exempt, such as basic substances, those authorized in organic farming, and those listed in the biocontrol roster. However, when a specific distance is stated in the product’s registration and labeling (rather than the general rules), that requirement takes precedence. In any case, a non-negotiable distance of 20 meters (about 66 feet) is required when the treated substance is deemed of concern.

A reduced distance of 5 meters

This particularly concerns substances identified as endocrine disruptors or considered to be carcinogenic, mutagenic, or toxic to reproduction (CMR1), whether proven or suspected. For products containing an active substance suspected of being carcinogenic, mutagenic, or toxic to reproduction (CMR2), the minimum distance is set at 10 meters (about 33 feet). For this distance to apply, it is also necessary that the specific use of the product appears on Annex 5 of the May 4, 2017 decree, a list regularly updated by the Ministry of Agriculture.

For all other products, the distance varies depending on the crop type. It is 10 meters (about 33 feet) for crops with a higher drift risk (orchard crops, vineyards, trees and shrubs, or forestry). For all other crops with lower exposure, the regulatory distance is reduced to 5 meters (about 16 feet).

Inform yourself about the crops

These 5- and 10-meter distances can, however, be adjusted or reduced. This modulation is possible if the treatment falls within an approved commitment charter and the farmer uses certified, specialized equipment designed to limit spray drift.

For nearby residents who want to verify compliance, the first step is to learn about the crops and the products used by the neighbor. If the neighbor refuses to disclose information, you can contact the local prefecture or the DRAAF. If a violation is found, an amicable solution can still be sought, or more formal actions can be pursued by appealing to the prefect or through the courts.
